Last week, the Sixth U.S. Circuit Court of Appeals sided with the state of Tennessee in a ruling against four plaintiffs who are men who identify as women who sought to change the sex on their birth certificates to reflect their self-declared gender identity. Writing the majority opinion, Judge Jeffrey Sutton stated that, quote, “there is no fundamental right to a birth certificate recording gender identity instead of biological sex.”

This court does not have jurisdiction over Wisconsin, but the ruling sends a powerful message nationwide that birth certificates need to reflect biological reality. Imagine the confusion if birth certificates can be changed at will to reflect a chosen identity. This isn’t over. We’ll see this issue before the US Supreme Court at some point. Hopefully, that court will also recognize truth.
