JD: There needs to be someone the President, the Executive Branch appointing a Justice to fill that vacancy and the Senate the Legislative Branch to give consent. Now having said that is there anyway the President and the Senate, the present President and Senate using an abuse of what they understand the law to be or their power to accomplish what the Constitution calls for?
SR: Well I should say the vacancy that now sits before the court is an obligation of the President, Executive Branch and to appoint a replacement. As you said the Senate is there to confirm that replacement. Right now there are nine Justices of the Supreme Court. One of them Ruth Bader Ginsburg as we’re discussing this has now died and that seat is open. There is some discussion Jimmy right now by some that are saying well the President should wait, he should wait until after the election. He should wait until after a new President is seated and the President said, no I need to move ahead because that’s what the Constitution says. In reality I can say Constitutionally there is no reason for a delay. That spot is to be filled. It is appropriate that the President wants to move swiftly.
There are four individuals believe it or not James Burns appointed by President FDR in 1941, George Sutherland appointed by President Harding in 1922, William Taft appointed by President Harding in 1921, Edward White appointed by President Grover Cleveland in 1894. Those four individuals actually were nominated and they were confirmed by the Senate on the very same day. So it is not a problem for this President to move ahead with an appointment with a seeking to fill this vacancy before the election as it is coming up.

It is not abuse of power for political leaders to follow the dictates of the Constitution of the United States. It was God who set human government in place to lead nations and political leaders to make decisions that will fulfill the will of God, that’s Genesis 9:6 and Genesis 10. These governments must be at full strength to set God’s will in place for the world today. A United States President will in fact make political decisions that sets God’s prophetic scenario in place for the future, that’s Revelation 17:17.
