Jim noted that there are reports that allies of Barack Obama are urging him to bypass Congress and expand his executive authority to change the law through decree. Robert cited President Obama’s “pretending” of a congressional recess into existence to make appointments to the Consumer Financial Protection Bureau and the National Labor Relations Board in opposition to Congress when Congress hadn’t gone into recess. The there was the issue of the Justice Department that took on the role of a court when they announced that the Defense of Marriage Act is unconstitutional.
Nothing within the Constitution allows for such activity. The president can sign a law or veto a law but under the concept of the separation of powers, only Congress can make laws.
This Crosstalk looks at numerous pieces of legislation and how they may be affected by government “overreach” including The Dream Act, The Affordable Care Act (Obamacare) and the Clean Water Act.
